Market sales: The same subject matter etching was sold at Strauss Fine Art Auctions on 9 April 2018 for the total amount of R4 104.00 (inclusive of buyer’s commissioner and VAT).

TERMS and CONDITIONS

In the absence of payment being made within 48 (forty-eight) hours of a purchase I ("the Seller")  reserve the right to cancel the sale and relist the item without any further correspondence or notification to the buyer. 

In the event of a purchase by a buyer of an item advertised for sale at a specified price and at that price ("the specified price item"), on Bid or Buy an agreement of sale will be deemed to have been concluded between parties by means of data messages at the time and place where:

i. the purchaser' acceptance of and decision to purchase  the specified price item was received by means of a data message transmitted to the Seller or

ii.in the case of an the prospective buyer making a reduced offer to purchase on terms which are less than those of the advertised item ("the reduced item offer") at the time and place where the Seller accepts the reduced item offer and conveys such acceptance through the Bid or Buy system to the purchaser. 

In other words in respect of both point i and ii above the jurisdiction in which the Seller resides and is either notified of the purchase of a specified price item or accepts the terms of a reduced item offer will be the jurisdiction in which exclusive jurisdiction is vested with the relevant Court in respect of any dispute pertaining to the sale of any item.
